1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and RetouchingShots ("Company," "we," "our," or "us") regarding your use of our website and photo editing services.

By accessing our website, placing an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

2. Services Description

RetouchingShots provides professional photo editing services, including but not limited to:

  • Clipping path and background removal
  • Photo retouching and enhancement
  • Image masking and manipulation
  • Color correction and adjustment
  • Ghost mannequin services
  • Jewelry and product retouching
  • Beauty retouching
  • Other related photo editing services

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Order Process and Acceptance

3.1 Order Placement

When you place an order, you must provide accurate and complete information, including:

  • Clear instructions and requirements for the editing work
  • Source images in acceptable formats
  • Correct contact information
  • Payment information

3.2 Order Acceptance

We reserve the right to accept or decline any order at our sole discretion. An order is considered accepted when we send you a confirmation email or begin work on your project.

3.3 Pricing

All prices are as quoted at the time of order placement. Prices may vary based on complexity, quantity, turnaround time, and other factors. We reserve the right to adjust prices, but will honor the price quoted at the time of order acceptance.

4. Payment Terms

4.1 Payment Methods

We accept payments through various methods, including credit cards, debit cards, and other payment processors. All payments must be made in the currency specified at checkout.

4.2 Payment Timing

Payment is required before we begin work on your order, unless otherwise agreed in writing. For large orders, we may require a deposit with the balance due upon completion.

4.3 Refunds

Refund policies are outlined in our Refund Policy. Generally, refunds may be available if work has not commenced, or in cases of service failure that cannot be remedied through revisions.

5. Client Responsibilities

As a client, you agree to:

  • Provide clear, detailed instructions for the editing work
  • Supply source images in acceptable quality and format
  • Ensure you have the legal right to use and edit the images you provide
  • Respond promptly to requests for clarification or approval
  • Review completed work in a timely manner
  • Provide feedback for revisions within the specified timeframe
  • Make payment as agreed

Failure to fulfill these responsibilities may result in delays, additional charges, or cancellation of your order.

6. Intellectual Property Rights

6.1 Client Ownership

Upon full payment, you own the rights to the edited images we deliver. You may use these images for commercial or personal purposes as you see fit.

6.2 Source Images

You represent and warrant that you own or have the legal right to use and edit all source images you provide to us. You are responsible for obtaining any necessary permissions, licenses, or releases.

6.3 Portfolio Use

We reserve the right to use completed work in our portfolio, marketing materials, and website, unless you specifically request otherwise in writing at the time of order placement.

7. Turnaround Time and Delivery

7.1 Estimated Turnaround

Turnaround times are estimates based on order complexity and current workload. While we strive to meet estimated deadlines, we do not guarantee specific completion times unless explicitly stated in a written agreement.

7.2 Delivery

Completed work will be delivered via the method specified in your order (email, download link, etc.). You are responsible for downloading and backing up delivered files.

7.3 File Retention

We typically retain project files for 90 days after delivery. After this period, files may be deleted. We recommend you download and backup all delivered files immediately upon receipt.

8. Revisions and Changes

8.1 Revision Policy

We offer revisions to ensure your satisfaction. The number of included revisions depends on your service package. Additional revisions beyond the included amount may incur additional charges.

8.2 Revision Requests

Revision requests must be submitted within 7 days of delivery and must clearly specify the changes needed. Major changes or changes that deviate from original instructions may be treated as new work and charged accordingly.

8.3 Approval

Once you approve the final work, the project is considered complete. Further changes will require a new order.

9. Cancellation and Refunds

9.1 Client Cancellation

You may cancel an order before work has commenced for a full refund. If work has begun, cancellation may result in partial refund based on work completed.

9.2 Company Cancellation

We reserve the right to cancel any order and provide a full refund if we determine we cannot complete the work to your satisfaction or if you violate these Terms.

9.3 Refund Processing

Refunds, when applicable, will be processed to the original payment method within 5-10 business days.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific order
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not responsible for loss of data, images, or files due to technical issues beyond our control
  • You are responsible for backing up all files and data

We provide services "as is" and make no warranties, express or implied, regarding the services.

11. Prohibited Uses

You agree not to use our services for:

  • Illegal activities or content that violates laws or regulations
  • Content that infringes on intellectual property rights
  • Pornographic, obscene, or offensive material
  • Content that promotes violence, hate, or discrimination
  • Fraudulent or deceptive purposes
  • Any purpose that could harm our reputation or business

Violation of this section may result in immediate termination of services and legal action.

12. Dispute Resolution

12.1 Good Faith Resolution

We encourage open communication to resolve any disputes. Please contact us first to attempt to resolve any issues.

12.2 Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

12.3 Arbitration

Any disputes that cannot be resolved through good faith negotiation may be subject to binding arbitration in accordance with applicable arbitration rules.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or email. Continued use of our services after changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must discontinue use of our services.
